The protracted detention of two Zambian men accused of having sex is an affront to all who believe in fundamental human rights, equality and non-discrimination and they should be released immediately, said Amnesty International today.
Amnesty International regards both men to be prisoners of conscience and is calling for their immediate and unconditional release.” Homosexuality is considered a crime under Zambia’s penal code, and if convicted, the two men face at least 14 years in prison. Both James Mwape and Philip Mubiana deny the charges against them.ZEST is a cluster-randomized trial designed to determine whether HIV self-tests are acceptable and improve HIV testing rates and HIV status knowledge among female sex workers in Zambian transit towns. The Secretary-General’s new approach to combat sexual exploitation and abuse also seeks to build a strong partnership with Member States and stamping out this scourge will require all relevant actors to find strength in unity. The Secretary-General calls on all parties to deliver on these goals together: “Let us do so in the name of all who look to the United Nations for life-saving protection and support – and on behalf of the tens of thousands of United Nations personnel around the world who deliver that assistance with courage and commitment to the highest ideals.”The Secretary-General is committed to the implementation of this strategy and has instructed and expects all his leadership to take immediate action.BACKGROUND The two men, both aged 22, were first arrested on 25 April 2013, and detained until 2 May, when they were released on bail.
They were arrested again on 6 May and subjected to forcible anal examinations by government doctors to “prove” their involvement in sexual activity. They have been charged with of having sex “against the order of nature” under Section 155 of Zambia’s Penal Code.
My ex boyfriends were all stingy but my dad gives me more than P6000 a month and I drive all his cars anytime I want to.
We started having sex after completing my form five when I was 17 years old and I dont want to leave him to go for tertiary because my mom might shift his attention from me.
Philip Mubiana and James Mwape, both in their early 20s, had been held since May last year and faced 15 years or more in jail for having sexual relations "against the order of nature".
The pair's lawyer William Ngwira said it was a "welcome" ruling, but added: "We are only sad that our clients have been in detention for over a year." The case had drawn the attention of rights groups and foreign governments, concerned that Zambia may be toughening its stance on gay rights following stricter new laws in Uganda and elsewhere in Africa.
My dad and I can do 6 rounds of sex a night and I really enjoy it.
